Gov’t proposes 15% exit tax on assets taken abroad

Hungary plans to introduce a 15% exit tax on unrealised investment gains when individuals move their tax residence abroad, aiming to prevent the transfer of assets overseas from eroding the country’s taxing rights.

The measure, modelled on rules in other EU member states, is set out in draft legislation submitted to parliament on Tuesday.

The tax would apply to individuals who had been Hungarian tax residents for at least five of the previous ten years and whose assets exceed Ft 500 million, or who hold at least a 20% stake in a company valued at no less than Ft 250 million.

It would apply where the change of residence causes Hungary’s right to tax the gains to cease or become restricted.

The taxable gain would be calculated using the assets’ market value on the day before the change of residence, meaning a tax liability could arise even if the investments had not been sold.

Those moving to another EU or European Economic Area (EEA) country would receive an automatic, interest-free deferral, subject to filing and reporting requirements, generally until the assets are sold or the wealth is withdrawn.

For relocations to other countries, the tax would be payable by the filing deadline for the relevant tax year.
