US court orders Croatia to pay $236mn to MOL



A Washington federal court has ruled that Croatia must pay $236 million to MOL in a case going back to 2013.

The decision makes a 2022 ruling by the International Centre for Settlement of Investment Disputes (ICSID) enforceable.

MOL sued the Croatian state in 2013 for failing to meet contractual obligations tied to the privatisation of the state oil company INA, as guaranteed by international agreements. MOL initially sought damages of $1 billion.

Croatia attempted to block the enforcement of the 2022 ruling in Washington, arguing that the court lacked jurisdiction.

However, in the latest ruling, a US federal judge rejected these arguments, stressing that under the ICSID Convention and the US legislation implementing it, courts are obliged to recognise and enforce ICSID awards as binding decisions.
